The Employees' State Insurance Corporation Headquarters, as directed by the Ministry of Labour and Employment, is providing "LESS LITIGATION – MORE COMPLIANCE" to ESIC registered employers under the Amnesty Scheme 2025. This scheme will commence from 1st October, 2025 and will remain in effect until 30th September, 2026. This is an ambitious initiative by ESIC to encourage compliance and resolve pending litigation. It aims to provide employers and insured persons with an easy, transparent, and cost-effective opportunity to settle long-standing ESI-related litigation, damages, interest, and coverage disputes. Shri Sunil Yadav, Director (In-Charge), Sub-Regional Office, Gurugram, explained the benefits and objectives of the scheme, stating that it will help reducing litigation and ease the burden on courts, thereby promoting ease of doing business.                                                                                        

                                                                                                               

Features of the Scheme -

1. Damages and interest can be waived off in eligible cases.

2. For the first time, coverage-related disputes have also been included in the scheme.

3. It provides an opportunity to settle disputes through an out-of-court settlement.

4. Cases older than five years in which no notice has been issued can be withdrawn.

Mr. Sunil Yadav said that the objective of the scheme is to provide employers an opportunity to resolve their pending cases, promote compliance, expand ESI coverage, and build goodwill and trust among stakeholders.

Damages, interest, and other disputes related to coverage will be settled under this scheme. The scheme aims to reduce the number of litigations and strengthen compliance under the ESI Act while providing relief to employers.

Employers Welcome the Scheme

The industry is particularly welcoming the scheme, and employers and Insured Persons whose cases have been pending before the courts for a long time are taking the initiative and expressing their willingness to settle their cases.
