The Food Safety and Standards Authority of India (FSSAI) has undertaken several measures to strengthen food safety, simplify regulatory compliance and promote the formalisation of food businesses. FSSAI is mandated to lay down science-based standards for articles of food and regulate their manufacture, storage, distribution, sale and import to ensure the availability of safe and wholesome food for human consumption.

The implementation and enforcement of the Food Safety and Standards (FSS) Act, 2006 is a shared responsibility of the Central and State Governments. To facilitate and encourage informal, small and petty Food Business Operators (FBOs) to come under the formal food safety and licensing framework, FSSAI has implemented the following key measures:

  • Introducing the provision for deemed registration of street food vendors, hawkers, food trucks, carts and similar food businesses registered under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 to address the dual compliance requirements for street food vendors, registered with municipal corporation and town vending committee.
  • Street food vendors and hawkers are completely exempt from the FSSAI registration fee. Applicable for both new registrations and renewals, eligible vendors can obtain a 5-year registration certificate completely free of charge.
  • To reduce the regulatory burden on FBOs and promote ease of doing business, FSSAI has introduced perpetual validity for licences and registrations. Earlier, licences and registrations were required to be renewed periodically, with validity ranging from one to five years. Under the revised framework, licences and registrations will remain valid indefinitely, thereby eliminating the need for periodic renewals while ensuring continued compliance with the provisions of the FSS Act, 2006, and the rules and regulations made thereunder.
  • Tatkal issuance of License/Registration has been implemented w.e.f. 28th June 2024 under certain kind of low-risk food businesses such as Wholesalers, Distributors, Retailers, Transporters, Storage without atmospheric control, Importers, Food vending agencies, Direct sellers and Merchant–Exporters.

The State-wise details of active Licences and Registrations issued under the Food Safety and Standards Act, 2006 are annexed at Annexure-I. Details of enforcement action taken for all non-conforming foods products (including adulteration) across the country (State-wise) in the last 5 years is annexed at Annexure-II, III, IV, V and VI respectively.

The Union Minister of State for Health and Family Welfare, Smt. Prataprao Jadhav, stated this in a written reply in the Rajya Sabha today.
