Corruption charges against defence officers

 RAJYA SABHA  

  The list of senior officers in Defence Forces facing charges of corruption and details of such cases, is given in enclosed statement.

            Indian Armed Forces are governed by their respective Acts namely Army Act, Navy Act and Air Force Act. Appropriate provisions exist in these Acts for taking action against Force personnel indulging in corrupt practices.

1.

Lt Gen SK Sahni, Major Gen BPS Mander, Brig SK Handa Brig PS Gill

A Court of Inquiry instituted to look into irregularities in procurement of dry rations indicted Lt Gen SK Sahni, Maj Gen BPS Mander, Brig SK Handa, Brig PS Gill and six others junior officers for various lapses. The General Officer Commanding in Chief (GOC-in-C), Western Command directed Disciplinary Action against Lt Gen SK Sahni, Brig SK Handa, Brig PS Gill and three other officers and Administrative Action against Maj Gen BPS Mander and three other officers.

Lt Gen SK Sahni has filed a writ petition against the Court of Inquiry. The Hon'ble Court has restrained the Government to progress the disciplinary action till the judgment in the writ petition. The Gen Officer has retired from service on superannuation w.e.f. 01st Oct 2006.

Maj Gen (now Lt Gen) SK Dahiya, Brig DVS Bishnoi

A Court of Inquiry instituted to inquire into the alleged irregularities int he operation of Meat Frozen Contract for Laddakh Sector in Northern Command indicted Maj Gen (now Lt Gen) SK Dahiya, Brig DVS Bishnoi and three other officers on various acts of omission and commission. GOC-in-C, Northern Command has issued his directions. The officer has filed a WP in the Hon'ble High Court of Delhi, which is being contested.

Maj Gen GI Singh Multani, Brig DS Grewal, Brig G Illangovan, Brigadier Rajeev Devikar, Brig RS Rana

A Court of Inquiry had indicted Major General GI Singh Multani, Brig DS Grewal, Brig G Illangovan, Brig Rajeev Devikar, Brig RS Rana and seven other officers  culpable of certain acts of omission and commission in sale of liquor and financial irregularities GOC-in-C, Central Command directed disciplinary action against the Gen Officer and administrative action against remaining ten officers.

Maj Gen (then Brig) KTG Nambiar, Brig (now Maj Gen) Rana Goswami

Based upon the findings of a Court of Inquiry held to investigate the allegations of various financial and other irregularities, GOC-in-C, Central Command directed Disciplinary Action against Maj Gen (then Brig) KTG Nambiar, subsequently promoted to the rank of a Maj Gen and Administrative Action against Brig (now Maj Gen) Rana Goswami and two other officers.

Brig SS Rao

A Court of Inquiry instituted to look into alleged incident of staging fake encounters under Eastern Command, found Brig SS Rao culpable of abetting staging of fake encounter by Commanding Officer of a unit. The GOC-in-C, Eastern Command directed disciplinary action against the officer.

Brig Iqbal Singh

As a result of 'Tehelka Expose', General Court Martial in respect of Brig Iqbal Singh has been completed this year and he has been awarded the sentence to be cashiered and to suffer vigorous imprisonment for two years.

Commander (SD ME) CS Singh

Commander (SD ME) CS Singh has been charged for abusing his position as a Public Servant, for commanding the making of false challans and for conduct unbecoming the character of an officer.

The officer has been sentence to (a) undergo rigorous imprisonment of 06 calendar months, to be dismissed from naval service, (b) forfeit 24 calendar months seniority in the rank of commander, (c) pay fine of Rs. 62,500/- and (d) suffer consequential penalties.

Commodore NMM Pandit

Commodore NMM Pandit has been charged for falsifying official documents, false declarations, knowingly making fraudulent statements, abusing his position as a Public Servant, possessing pecuniary resources disproportionate to his known sources of income and for conduct unbecoming the character of an officer.

The officer has been sentenced to (a) undergo rigorous imprisonment of 18 calendar months, (b) dismissal from naval service, (c) forfeit 36 calendar months seniority in substantive rank of Capt, (d) pay fine of Rs. 3 lakhs, and (e) suffer consequential penalties involved.

9.

Lt Cdr (SDAE) MP Verma

Lt Cdr (SDAE) MP Verma has been charged for cruelty, conduct unbecoming the character of an officer, abusing his position as a Public Servant and for possessing pecuniary resources disproportionate to his known sources of income.

The officer has been sentenced to (a) undergo simple imprisonment of 12 calendar months, (b) dismissal from Naval service, (c) pay fine of Rs. 6,91,700/- and (d) suffer consequential penalties.

The Execution of sentence stayed by Hon'ble High Court of Delhi.

10.

Cdr AG Gandhi

Cdr AG Gandhi has been charged for cruelty and conduct unbecoming the character of an officer and for knowingly making a fraudulent statement.

(b) forfeit 12 calendar months seniority in substantive rank of Commander and (c) pay fine of Rs. 7870/- only and (d) suffer consequential penalties involved.

11.

Group Captain Shamsher Singh

Group Captain Shamsher Singh was tried by a General Court Martial a charge relating to corruption.

The General Court Martial awarded the following punishments:-

(a)     Forfeiture of seven years of service for promotion

(b)     Forfeiture of five years of service for increased pay.

(c)     Severe Reprimand.

12.

DIG SK Dey

One case of financial and procedural irregularities / misappropriation of funds against DIG SK Dey has come to notice.

A prima facie case was established against the officer and he was attached to Indian Coast Guard Ship, Chennai for initiation of disciplinary action against the officer. Before the disciplinary proceedings could be initiated, the officer approached Madras High Court and obtained interim stay, which is still in force.
